Can you rent out a granny flat in Australia?
In most Australian states, yes — and in several this changed only recently. The historical position in a number of jurisdictions was that a secondary dwelling could only be occupied by a member of the same household, which made granny flats family accommodation rather than an income proposition.
Where it has changed §
- Queensland — occupancy restrictions were removed in 2022. A secondary dwelling can generally be rented to anyone, subject to approvals and compliance.[1]
- South Australia — the family-only restriction has been removed, with legislation ensuring both existing and new ancillary accommodation can be rented to anyone.[2]
- Western Australia — renting to private tenants, students or short-term guests is permitted, with short-term letting requiring registration on the state-wide register.[3]
What you cannot do §
Renting is not the same as separating. In New South Wales, a secondary dwelling sits on the same lot and title as the principal home and cannot be sold separately.[4] You are renting a dwelling on your own title, not creating a subdividable asset.
That distinction matters for valuation, for finance, and for anyone assuming a granny flat produces a separately saleable property.
Short-stay letting is a separate question §
Permission to rent long-term does not automatically extend to short-stay platforms. Western Australia requires registration on a state-wide register for short-term rental arrangements,[3] and many councils elsewhere apply their own short-stay rules independently of state secondary dwelling provisions.
If short-stay income is central to the business case, confirm it specifically rather than inferring it from general rental permission.
Before you rely on rental income §
- Confirm your state's current occupancy position.
- Confirm your council's position — some rules are set locally.
- Check short-stay letting separately if that is the plan.
- Confirm any registration or licensing obligations.
- Check how rental income affects your lending assessment, and how the dwelling is valued.
